Terms and Conditions

How to Order

Order using our online Catalog or email us using Contact Us or call our toll free number 1-800-298-9880. Orders are fulfilled in the order received dependent upon inventory on hand and may be delayed if out of stock. Most items displayed are in stock.

Design Help

Need pre-sales advice and recommendations, we'd love to help. Send us a rough drawing or architectural drawing or pictures. Together we can work towards a satisfactory installation solution. It is ultimately up to the customer to determine which type of product, its size and distinguishing features (such as collars etc.) would be best for their unique situation, lab, or building. We do not offer a satisfaction guarantee, therefore it is important that the consumer knows their requirements before ordering. Purchaser to furnish all requirements for installations, including but not limited to installation labor and materials, electrical circuitry, governmental code requirements, alterations to existing facilities, and proper form and function.

Price Changes

Although we make every effort to keep our price list current, we reserve the right to change prices or specifications at any time without notice. Currently, we have not had an overall price increase since October 2021.

Return and Cancellation Policy

FSP manufactures most all of its products. We do not sell refurbished or used units. We offer pre-sales advice and recommendations; however, it is ultimately up to the customer to determine which type of product, its size, functionality, and distinguishing features (such as collars etc.) would be best for their unique situation, lab, or building. We do not offer a satisfaction guarantee, therefore it is important that the consumer knows their requirements before ordering. If the customer changes their mind within five days of our ship date, FSP may accept returns under the following conditions. Returns are only accepted with an authorization number issued by FSP. The returned product must be factory fresh, unused, unopened in the original box with all accessories. Because we can not resell Custom Ordered items we do not authorize or issue refunds for Custom Orders. Because we can not resell products that have been used, only products which are unused and new may be returned. If the product has been used in any way it can not be returned. All authorized returns must be returned within 15 days of the FSP ship date and must be shipped prepaid to address we will supply with our authorization number. All authorized returns are subject to a 30% restocking fee and the shipping charges to the customer are not subject to a refund. Any FSP paid return shipping charges will be subtracted from your refund total. If you meet all of the above guidelines, you may request an authorization number by calling 1-800-298-9880. For your protection please insure returns for the full value of the original purchase price. FSP is not responsible for damage or loss that occurred on the return shipment. Your adjusted refund amount will be processed within 10 business days of receipt of the products. Excludes Custom Orders, special orders, OEM, Scratch & Dent, or obsolete items which cannot be returned for credit. Certain conditions apply. Please call for details. All material must be in saleable condition and return freight paid by the customer.

Freight Terms

Orders that cannot ship via FedEx, USPS, or UPS will ship from our warehouse using the most cost-effective carrier. Unless your order qualifies for free freight the order will ship collect and you will be responsible for the freight charges. FOB Madison Wisconsin. For your protection, we recommend that you inspect all items before accepting delivery. If you discover a shortage or damage – please do not refuse the shipment. Note the shortage or damage on the freight bill and notify FSP within 3 days of receiving the shipment. We will assist you with filing a freight claim. Without the discrepancy or damage documentation in writing a freight claim may be denied. Again, any discrepancies MUST be reported within 3 days of receiving your shipment.

Payment Terms

All orders placed without prior credit approval must be either prepaid using Visa/MasterCard/Discover/American Express/PayPal, or Company Check. FSP will charge $40.00 for each check returned unpaid.

Refund Policy

Cancellation Policy

Cancellations

If you wish to cancel an order, you will need to do so within 2 hours of ordering Monday – Friday to insure the order does not ship. If you order on Saturday or Sunday, cancel before 10:30 am Monday morning. If the order is placed on a legal holiday then you must cancel on the next business day before 10:30 am. Please call 800-298-9880 to cancel the order. If you do not reach a live person, please leave a message. Once an order has shipped, it is subject to the refund policy (see above). This section only applies to non Custom Orders or Custom Order items.

Delivery, Cancellation, Warnings, Waivers Policy, Ect..

Correct Address

When placing an order, please make sure your shipping address is correct. UPS and freight carriers charge us fees to correct incorrect shipping addresses. If the address we are given is proven to be incorrectly provided by the customer, we will pass that charge on to the customer.

Construction Site Address

When shipping to a construction site, please let us know so that the information can be supplied to the freight company.We would be happy to assist when possible in coordinating job site deliveries. There may also be added charge for deliveries to construction sites. Any added charges will be the responsibility of the customer.

Prior Delivery Notification

Notification of 24 hours in advance of freight delivery is available when possible.

Not Responsible For Force Majeure

FSP is not legally nor financially liable for "force majeure" for performing or under-performing any of their contractual obligations when certain circumstances beyond their control arise, making performance inadvisable, commercially impracticable, illegal, or impossible. Force majeure includes but is not limited to natural disasters like hurricanes, floods, earthquakes, and weather disturbances sometimes referred to as "acts of God." Other covered events include declared or undeclared war, terrorism or threats of terrorism, civil disorder, labor strikes or disruptions, fire, disease or medical epidemics or outbreaks, and curtailment of transportation facilities preventing or delaying ship to deliveries.

Tracking Information

Any Tracking information provided by FSP and or third parties are not to be considered accurate and therefor FSP assumes no responsibility for their accuracy, use, and or reliance upon.

Local Code

Purchaser to furnish all requirements for installations, including but not limited to installation labor and materials, electrical circuitry, governmental code requirements, alterations to existing facilities, and proper form and function.

Purchaser is cautioned to install and operate FSP purchased items in accordance with prescribed Federal, State, OSHA, NFPA, local codes and regulations. This equipment should be installed / wired by a licensed installer and or electrician following all applicable codes. Local codes can be significantly different than national codes.

The customer assumes the responsibility for contacting their insurance underwriter with regard to specific application requirements of venting or if additional fire protection and safety equipment may be required.

Waiver Of Liability

Laboratories and research facilities exhaust a wide variety of harmful fumes. In concentrated forms, these fumes can be hazardous to human life. Contaminated air must be exhausted in a way that prevents it from returning into the building and surrounding locations where people may be present. To effectively exhaust these fumes, which in many cases are corrosive and/or explosive in nature, fans are connected to one or more fume hoods to draw the contaminated air through. For proper ventilation, exhaust fans must be capable of moving air at high velocities to achieve a high plume height, as well as entraining clean ambient air to dilute the chemical concentration in the air-stream. Our exhaust system kits, parts, or components are not safe for nitrous oxide flame applications and should not be used or modified for such use.

***WAIVER OF LIABILITY***

All users are responsible for being educated on the unit’s proper use, to include the use of any fume vented equipment and any other associated ventilation use with the FSP products. Insure health and safety precautions are adhered to as with any electrical appliance. Avoid skin and hair contact with all FSP components during usage and after usage until item reaches room temperature.

The purchaser of a FSP product, on behalf of him or herself and all agents, employees, assignee, administrators, or executors and hereby release, discharge, and waive all claims of liability against FSP and/or its employees for any injuries, damages, or loss of any kind that might be sustained while using this equipment. This waiver applies to any third party sale or transference of the product. Placing an order for any FSP product indicates your acceptance of these terms and conditions.
